Choose which employees are covered

Depending on which product you use, your business can make many decisions about employee eligibility.

 

QSEHRA

Who can participate in the benefit?

  • Under federal law, you must offer the benefit to all full-time W-2 employees.
  • You can choose whether or not to offer the benefit to part-time employees.

Who is not eligible to participate?

  • 1099 employees
  • S-corp owners with greater than 2 percent ownership

ICHRA

Who can participate in the benefit?

You can choose to offer the benefit to any or all of the following:

  • Full-time employees
  • Part-time employees
  • Salaried employees
  • Hourly employees
  • Employees in state
  • Employees out of state

You can also choose to combine any of the above characteristics to set eligibility. For example, you could offer the benefit only to full-time, salaried employees or only to full-time employees who work in-state.

  • Employees must have coverage under an individual health insurance policy to be eligible.

Who is not eligible to participate?

  • 1099 employees
  • S-corp owners with greater than 2 percent ownership
  • Employees without individual health insurance
