The law only permits employers with one or more W-2 employees to offer an ICHRA.
Per Affordable Care Act requirements, if you have 50 or more full-time equivalent employees, you must demonstrate that the amount you are reimbursing employees through an HRA is enough to make individual health coverage affordable.
